THE FLORIDA SUPREME COURT DECISION
The Florida Supreme Court will be sharing their decision on the 15 week abortion ban lawsuit soon. The court heard arguments claiming it violates the state’s constitution on September 8, 2023. In the Constitution of Florida it states in Article 1, Section 23, “Every natural person has the right to be let alone and free from government intrusion into the person’s private life.” In July 2022, a lower state court ruled that the 15 week abortion ban violated the Florida Constitution. The state promptly appealed. If they rule in support of the ban, the new 6 week ban will go into effect 30 days after the decision is announced.
Concerns have existed with the 15 week abortion ban’s effect on women’s health and lives. Abortion restrictions have disrupted the standard of care for pregnancy complications. Women with potentially life-threatening pregnancy complications are being denied care which would have been provided before Roe v. Wade was overturned. Doctors are fearing the legal risk that might come with terminating a pregnancy even when the pregnancy is jeopardizing women’s well-being and possibly her life.
We hope that the Florida Supreme Court will view the law to ban abortion as overturning the rule of law and not following the privacy clause within the Constitution of Florida.
